These Terms of Use (the “Terms”) form a legally binding agreement between you (“You” or the “Learner”) and One Dev Limited (“One Dev”, “We”, “Our” or “Us”). These Terms govern your access to and use of One Dev’s website, learning portal, course content, communication channels, and any other digital or offline platform operated by One Dev (together, the “Platform”).
By creating an account or accessing the Platform, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not accept these Terms, you must immediately discontinue your use of the Platform.
We reserve the right to revise or update these Terms at our discretion. Continued use of the Platform following any update will constitute your acceptance of the revised Terms.
Unless the context requires otherwise:
Account: A personal profile created by the Learner on the Platform to access One Dev’s services.
Course Content: Educational resources, including text, images, audio, videos, software tools, assignments, and any other learning materials made available by One Dev.
Course Fees: Tuition or subscription payments required for access to specific courses or programmes.
Learner: Any individual enrolled in or accessing One Dev’s courses.
Personal Data: Information that identifies or relates to an individual learner, including name, contact details, billing information, demographic details, and any other information collected through the Platform.
Privacy Policy: One Dev’s data protection policy, which sets out how Personal Data is collected, stored, and processed.
Site: The official One Dev website accessible at [www.onedev.club].
2.1 Access to the Platform and Course Content is granted subject to your full compliance with these Terms and any additional policies introduced by One Dev.
2.2 Certain courses or features may be subject to supplemental terms. If there is a conflict, those supplemental terms will take precedence for the relevant course or feature.
2.3 One Dev may modify, suspend, or discontinue any aspect of the Platform (including access to particular courses or features) without prior notice.
3.1 To participate in One Dev programmes, you must register and create an Account on the Platform. During registration, you must provide accurate, current, and complete information.
3.2 Learners must be at least 16 years old to register. By creating an Account, you represent that you meet this requirement.
3.3 You are solely responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your Account.
3.4 If you suspect unauthorised use of your Account, you must notify One Dev immediately.
4.1 By signing up, you consent to receiving communications from One Dev electronically. These may include newsletters, updates, reminders, course notifications, legal notices, trends and any relevant information.
4.2 Electronic communications shall carry the same legal effect as written notices.
As a Learner, you agree to:
Abide by One Dev’s Code of Conduct.
Pay all applicable Course Fees upon acceptance of admission or enrolment.
Use Course Content for personal learning only, and not copy, resell, or redistribute it.
Participate actively in projects, assignments, and interactive sessions.
Notify One Dev if you intend to defer or withdraw from a programme.
Provide your own learning resources, such as laptops and a stable internet connection.
Avoid actions that could disrupt the Platform or infringe on the rights of others.
6.1 Course Fees must be paid in full (or in accordance with an agreed payment schedule) to access Course Content.
6.2 One Dev partners with third-party payment processors. By paying fees, you authorise One Dev to share your information with such processors. You must also comply with the processor’s terms and policies.
7.1 All intellectual property rights in the Platform and Course Content remain the exclusive property of One Dev.
7.2 Learners are granted a limited, non-exclusive, non-transferable licence to access Course Content for personal educational purposes only.
7.3 No part of the Course Content may be copied, reproduced, distributed, or modified without prior written consent from One Dev.
8.1 One Dev may offer scholarships, referral rewards, or promotional discounts. Such benefits will be subject to specific eligibility rules and terms communicated at the time of offer.
8.2 Unless otherwise stated, promotions are non-transferable, non-refundable, and may expire if unused within the stated period.
9.1 You retain ownership of any content you submit (e.g., projects, assignments).
9.2 By submitting content, you grant One Dev a worldwide, royalty-free licence to use, reproduce, modify, distribute, and promote such content in connection with the Platform.
One Dev may suspend or terminate your Account if:
You fail to pay Course Fees when due.
You repeatedly fail to participate in assignments or activities.
You violate the Code of Conduct or engage in academic dishonesty.
You misuse the Platform or infringe intellectual property rights.
11.1 One Dev may suspend or terminate your Account with or without notice if you breach these Terms.
11.2 Upon termination, you will lose access to the Platform and Course Content.
You agree to indemnify and hold harmless One Dev, its officers, directors, employees, and affiliates against any claims, damages, or liabilities arising from your misuse of the Platform or violation of these Terms.
One Dev shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform, including loss of data, profits, or business opportunities.
Neither Party will be held responsible for delays or failures caused by events beyond reasonable control, including natural disasters, strikes, internet outages, or government actions.
15.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.
15.2 Any dispute that cannot be resolved amicably within 30 days shall be referred to arbitration in Nairobi, Kenya, under the rules of the Nairobi Centre for International Arbitration (NCIA).
15.3 The decision of the arbitrator shall be final and binding on both Parties.
These Terms constitute the full understanding between you and One Dev and supersede any prior terms, policies or representations.
